Nathan, thank you for your comments. As far as a lawsuit, the law in Massachusetts, as I understand it, is that you can't sue unless you are out of pocket more than something like $2500. Since my son is a child, he didn't miss any work. Since the insurance and the Shriner's hospital paid all the bills, we had no medical expenses other than a small copay. Thus, at least to the fine folks of Massachusetts, we have no loss and no reason to sue.

I understand your pain, and, I hope all is well with your child. I am also dealing with a not so Friendly's
on a burn case with my daughter across her chin and chest with coffee that was placed in front of a 10 mth. last 09'. the only concern was who's going to pay the bill. And, nobody was fired or no help or apologies were offered. Just remember, if you were to take 2 of there waiters/waitresses and took there brains and put them together you still would not a whole whole brain. And, yes you have a lawsuit.

Hey Jeff, I feel sorry for what happened to your baby boy at the resturaunt. I would send the pictures to the resturaunt owner, manager, and waitress. Better yet do that and then walk in the resturaunt with a microphone and tell the story of what happened to your kid. Oh and smile when you look at the manager and the waitress that caused the horror.

I did my research and homework before I purchased my house. Why should my taxes or anything else go to help people who bought a place that they knew they couldn't afford in the long run?

While that may be true, why should I have to pay for other peoples irresponsibility? I live within my means so therefore I must pay for the people that don't. That doesn't really seem to make much sense.

To further illustrate the silliness of your argument, let me try an example. I could afford to buy you a new car. That does not mean that I will. If, for example, you choose to spend all your money on clothes, or entertainment or drugs, or whatever else you may like, and have no money left for a car, why would I buy you one? Just because you CHOSE to spend your money on something else doesn't mean that I should spend mine to make up for it.

It comes down to something I have said over and over again. Poor planing on your part does not constitute an emergency on mine!

I think you should do it. But the first person who left a comment shouldn't of cused!!

How about those auto flush toilets that either flush in the middle of the job and then won't flush again, or just refuse to flush at all?

I broke my toe @ a Friendly's restarunt in CT, they had a huge hole in the side walk and no outside lights on, when I went in to tell the manager she said I was cutting in line, i went back outside 2 sit with my mom(plus my toe was bleeding) and the manager STILL didnt come out to check on me and the situation so...my mom took the big piece of rock that was covering the huge hole and cut the line and put it on the counter, my mom said "maybe now you can come and take care of this situation" the manager then replied "i cant believe you would make my counter unsanatary by putting a rock on it" while i was sitting outside waiting another person almost tripped in the hole!! Needless to say Im involved in a lawsuit with them now and I had to have surgery on my toe!! If you have any info that might be helpful i would appreciate it. Is your son ok? Does he have any scars from this?

"Scenting" the air is a dangerous practice, and might possibly be illegal if pursued through the courts.

Here's why: my daughter is a severe asthmatic. Perfumes can cause an anaphylactic reaction causing her death. And I have been known to suffer severe migraines caused by scents.

About 10 years ago, an asthmatic woman dropped dead in Macys because the annoying 'perfume sprayers' sprayed her without her permission and she was allergic to it. It became illegal to spray a customer with perfume without asking them first.

"Scenting" the air can be considered a similar kind of assault and should be treated as such in a court of law.

Thank you for posting this. As a first-time parent of an 8 month old baby, I was appalled to read how this happened and how badly you were treated. It is reprehensible that you have no legal recourse in MA. The parties should be held responsible regardless of whether you incurred financial loss. A child was injured and there's nothing to deter them from allowing this to happen again? As an attorney (not in MA), I find this shocking. I hope your son has no scars from this ordeal, and I'm sorry you all had to go through it.

Since you obviously can't read let me clarify a few points:

1. The waitress put down the syrup without telling us. She put it in front of our son instead of in front of us. We did not see her put it down as she did it as she walked by. Had we SEEN her actually put something on the table INCHES AWAY FROM A BABY we might have stopped her.

2. Since she put the syrup down closer to the child than to us, even if we saw her do it, there would not have been time to take it away before he reached it.

3. SYRUP SHOULD NEVER BE 180 Degrees!!! Even the companies own policy says that!

4. The syrup was in a bowl like container that was unstable.

5. The manager tried to stop me from helping give first aid to my injured son because of his concern for my getting a little water on the rug!

6. The district manager (according to the store manager) tried to cover the whole thing up.

So let me see if I understand your logic:

It is somehow my fault that a careless waitress put boiling hot syrup, against company policy, in a flimsy bowl, in front of a 10-month-old without even stopping long enough to tell us she put it there, much less to tell us it was hot.

It is also my fault that the manager tried to stop me from giving the same child first aid (thus potentially making the injuries worse).

YOUR child? Where were you?!? You as a parent are supposed to watch your child at all times?!? Im sure the silverware (KNIFE, fork, and spoon) were in front of your child when you sat down too, and Im sure you moved those out of the way! Take responsibility for you children and stop blaming others for what YOU do wrong!

Thank you for your support. I don't know, I'm not really interested in kicking "some ass" as you put it. All I ever really wanted was an apology. I'm sure I will never get one from any of the parties involved, but still, it would've been nice.
