As far as a lawsuit, the law in Massachusetts, as I understand it, is that you can't sue unless you are out of pocket more than something like $2500.  Since my son is a child, he didn't miss any work.  Since the insurance and the Shriner's hospital paid all the bills, we had no medical expenses other than a small copay. Thus, at least to the fine folks of Massachusetts, we have no loss and no reason to sue.</description>

	<description>I broke my toe @ a Friendly's restarunt in CT, they had a huge hole in the side walk and no outside lights on, when I went in to tell the manager she said I was cutting in line, i went back outside 2 sit with my mom(plus my toe was bleeding) and the manager STILL didnt come out to check on me and the situation so...my mom took the big piece of rock that was covering the huge hole and cut the line and put it on the counter, my mom said "maybe now you can come and take care of this situation" the manager then replied "i cant believe you would make my counter unsanatary by putting a rock on it" while i was sitting outside waiting another person almost tripped in the hole!! Needless to say Im involved in a lawsuit with them now and I had to have surgery on my toe!! If you have any info that might be helpful i would appreciate it. Is your son ok? Does he have any scars from this?</description>

Since you obviously can't read let me clarify a few points:

1. The waitress put down the syrup without telling us.  She put it in front of our son instead of in front of us.  We did not see her put it down as she did it as she walked by.  Had we SEEN her actually put something on the table INCHES AWAY FROM A BABY we might have stopped her.

2.  Since she put the syrup down closer to the child than to us, even if we saw her do it, there would not have been time to take it away before he reached it.

3.  SYRUP SHOULD NEVER BE 180 Degrees!!!  Even the companies own policy says that!

4.  The syrup was in a bowl like container that was unstable.

5.  The manager tried to stop me from helping give first aid to my injured son because of his concern for my getting a little water on the rug!  

6.  The district manager (according to the store manager) tried to cover the whole thing up.

So let me see if I understand your logic:

It is somehow my fault that a careless waitress put boiling hot syrup, against company policy, in  a flimsy bowl, in front of a 10-month-old without even stopping long enough to tell us she put it there, much less to tell us it was hot.

It is also my fault that the manager tried to stop me from giving the same child first aid (thus potentially making the injuries worse).</description>

4.  The syrup was in a bowl like container that was unstable.<br />

5.  The manager tried to stop me from helping give first aid to my injured son because of his concern for my getting a little water on the rug!  <br />

6.  The district manager (according to the store manager) tried to cover the whole thing up.<br />

So let me see if I understand your logic:<br />

It is somehow my fault that a careless waitress put boiling hot syrup, against company policy, in  a flimsy bowl, in front of a 10-month-old without even stopping long enough to tell us she put it there, much less to tell us it was hot.<br />

Thank you for your support.  I don't know, I'm not really interested in kicking "some ass" as you put it.  All I ever really wanted was an apology.  I'm sure I will never get one from any of the parties involved, but still, it would've been nice.
